Hemp and Marijuana are both Cannabis. Legally Hemp is just cannabis that contains 0.3% THC or less. When the plant has more than 0.3% THC, it becomes Marijuana. You can even legally invest in Cannabis companies, so things are changing fast!


2018 Farm Bill

Not long ago, you couldn’t grow any type of cannabis at home. Slowly at first, states started to adopt medical marijuana programs. Then, the 2018 Farm Bill made hemp legal and allowed for it to be grown nationally by licensed farmers. Additionally, hemp and hemp derived products can now be sold throughout the US.


Fast forward to today, and there are many states where it is legal to grow your own hemp at home for personal use. Let’s walk through some of the details, point by point.


Does my state allow me to grow at home?

Many states allow for growing hemp at home, however each state’s laws are a little different. You’ll want to check your state, county, and city rules around growing at home. You check check out this website which contains information for every state.

How old do I need to be?

Most states require you to be 21 years or older. Therefore, GrowItFromHome requires all customers to be 21 years or older.


Can I share my hemp with my friends and family?

Yes! You can absolutely share it. Jar the flower and give it away. Share bouquets. Make tasty CBD treats and invite some friends over. However, you just can’t turn it into a CBD cupcake and sell it to someone. There are state specific laws, and licenses that you would need to turn your hemp into a business. So, draw the line at a ‘business’ but by all means gift this herb/vegetable wonder to your friends and family just like you would a box of tomatos or homemade pesto.

In California, there is no state registration required to grow hemp. To be fully compliant, you only need to complete a county registration. There are some counties and cities that do not allow for growing hemp, so you’ll need to check your local rules first.
